1. Formation of the contract.

These Terms of Purchase govern the purchase of products through this website. By placing an order, you offer to buy the products in the order on these terms. The contract is formed when we confirm the order by sending an order confirmation through the contact method provided at checkout. Before confirmation, we may decline or cancel an order for reasons including product unavailability, a pricing or description error, a suspected fraudulent transaction, a shipping restriction, or a destination-specific restriction on high-powered magnets that was disclosed at checkout or that could reasonably have been discovered.

An order confirmation is not an acceptance of every term you may have included in a purchase order or communication; it is an acceptance of the order on the terms described here and in the Shipping Policy, the Refund Policy, and the Privacy Policy. If an order is declined after payment authorization, the authorized amount is released or refunded under the Refund Policy’s processing time.

2. Pricing and currency.

All prices are displayed in USD. The price displayed at checkout for the merchandise, together with any applicable tax that is separately stated, is the amount charged. Shipping is free under the Shipping Policy and is not added as a separate charge. Duties and import-related charges on international orders are covered by us under the Shipping Policy; they are not charged to you at delivery.

We reserve the right to correct a pricing error before an order is confirmed. If an order is placed at an incorrect price and the error is material and discoverable, we may cancel the order and refund the amount paid rather than fulfill at the incorrect price. If an order has already been confirmed and the pricing error is not attributable to you, we will contact you through the Contact page to offer the choice of cancellation with a refund or fulfillment at the corrected price. A discount displayed as a percentage off is calculated against the reference price shown on the product page at the time of the order; a reference price that is later corrected does not retroactively change a confirmed order unless the error was material and the order is handled under the correction process described here.

3. Payment authorization and fraud screening.

Payment is authorized at checkout through the payment processor. An authorization is not a capture; the capture occurs when the order is confirmed and processed. If the processor declines the transaction, the order is not confirmed, and no contract is formed for that order. We may use fraud-screening tools that evaluate transaction and device information; an order may be held or declined if the screening result indicates a risk. If an order is held, we may contact you through the order confirmation channel for verification. Failure to provide verification within a reasonable period may result in cancellation and release of the authorization.

4. Product descriptions, magnetic characteristics, and availability.

Product descriptions, images, material specifications, and piece counts are provided in good faith and are intended to be accurate. Minor variations in coating color, surface sheen, or packaging appearance may occur because of manufacturing batch differences; such variations are not defects unless they materially change the product’s disclosed material or performance.

The products sold on this website contain small, high-powered neodymium magnets. They are intended for adults and teens aged 14 and older. They are not toys for children. The product page states the applicable age restriction, the magnet size and material, and the handling warnings, including the instruction to keep the product away from all children and to never place the magnets near or in the nose or mouth. By placing an order, you acknowledge that you have read the age restriction and the handling warnings and that you will use and store the product in accordance with them.

Availability is not guaranteed until an order is confirmed. If a product becomes unavailable after an order is placed but before confirmation, we may cancel the order and refund the amount paid, or contact you to offer an alternative.

5. Age eligibility and safety acknowledgments.

By placing an order, you represent that you are at least the age of majority in your jurisdiction and that the product will be used by a person aged 14 or older. You acknowledge that the product contains small, high-powered magnets; that swallowed magnets can attract each other through the intestinal wall and cause serious injury or death; that the product must be kept away from all children; that the magnets must never be placed near or in the nose or mouth; and that a magnet with a cracked or chipped coating should not be used until the condition has been assessed.

This acknowledgment does not shift responsibility for the accuracy of the product labeling or the safety of the product as manufactured to you; it is a statement that the handling of a high-powered magnetic product involves risks that a website cannot eliminate and that the age restriction and warnings are conditions of safe use.

6. Shipping, delivery, and risk of loss.

Shipping and delivery are governed by the Shipping Policy. Processing time is one to three business days; the estimated delivery window is six to twelve calendar days after the order is placed. Title and risk of loss pass to you upon delivery to the address you provide, or upon delivery to a carrier-designated collection point where the carrier’s tracking record confirms delivery. If a parcel is lost or damaged in transit, the Shipping Policy’s lost-parcel and damage provisions apply.

For magnetic products, risk of loss includes the risk of coating damage from impact during transit after delivery to the carrier, to the extent the carrier’s handling is outside our control. Inspect the container and the magnets upon delivery and report any visible compromise through the Contact page.

7. Returns and refunds.

Returns and refunds are governed by the Refund Policy. The return window is sixty calendar days from delivery. Refunds are processed within five to ten business days after an approved return is received and inspected. The Refund Policy describes the completeness requirement, the condition requirements for magnetic sets, and the treatment of damaged or defective items. By placing an order, you acknowledge that you have had the opportunity to review the Refund Policy and that it forms part of the contract. The completeness requirement is a condition of resale and safety, not a penalty, and it applies equally to all customers.

8. Duties, taxes, and import charges.

International orders are shipped with duties and import-related charges covered by us, as described in the Shipping Policy. You are not required to pay additional amounts to the carrier or a customs authority to receive the order. This commitment does not make us the importer of record, and it does not relieve you of the obligation to respond accurately to a lawful request for information from a customs authority if one is made directly to you. If a destination restricts the import of high-powered magnets, the order may be cancelled and refunded under the Shipping Policy’s destination-restriction provision.

9. Limitation of liability.

To the maximum extent permitted by applicable law, our liability arising out of or relating to an order is limited to the amount you paid for the merchandise in that order. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, loss of use, or loss of data, arising from the purchase or use of a product, except where such limitation is prohibited by law. Nothing in this section limits liability for fraud, willful misconduct, or any liability that cannot be limited under applicable consumer protection law.

For a magnetic product, this limitation does not exclude liability for a failure of the product to conform to its disclosed material or piece-count specification, for a labeling error, or for a safety defect that is attributable to our acts or omissions. It does limit liability for outcomes that depend on use inconsistent with the age restriction or the handling warnings, or on a failure to seek medical attention after a suspected ingestion.

10. Indemnification.

You agree to indemnify and hold us harmless from claims, damages, losses, and expenses, including reasonable attorneys’ fees, arising from your breach of these terms, your misuse of a product, or your violation of applicable law, except to the extent the claim is caused by our negligence or willful misconduct. This provision does not apply to a consumer claim that applicable law prohibits from being subject to indemnification. Misuse includes permitting a person under the age of 14 to use or access the product, using a product with a compromised coating, or disregarding a handling warning.

11. Governing law and dispute resolution.

These terms are governed by the laws of the jurisdiction in which the store operator is established, without regard to conflict-of-law principles, except where applicable consumer protection law requires the application of the consumer’s local law. Any dispute that cannot be resolved through the Contact page process will be subject to the exclusive jurisdiction of the courts located in that jurisdiction, unless applicable law provides a different forum that cannot be waived. Before initiating a legal action, you agree to contact us through the Contact page and allow a reasonable period for resolution; this step is intended to resolve disputes efficiently and does not waive any right.

12. Severability and entire agreement.

If any provision of these terms is found unenforceable, the remaining provisions remain in effect, and the unenforceable provision is modified to the minimum extent necessary to make it enforceable. These terms, together with the Shipping Policy, the Refund Policy, and the Privacy Policy, constitute the entire agreement between you and us regarding the purchase, and they supersede any prior or contemporaneous communication on the same subject.
